Introduction

Welcome to Dolevate. These Terms of Service ("Terms") govern your use of our mobile application and services. By accessing or using our application, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the application.

Definitions

• "Application" means the Dolevate mobile application.

• "Services" means all features, functions, and services provided through the Application.

• "Subscription" means recurring payment for access to premium features of the Application.

• "User", "You", and "Your" refer to the person accessing the Application.

• "We", "Us", and "Our" refer to Dolevate.

• "AI Services" refers to the artificial intelligence services provided by third-party partners DeepSeek and OpenAI.

• "AI-Generated Content" refers to subtasks and other content generated by AI Services based on user inputs.

• "Goal" refers to user-created objectives entered into the Application.

• "Subtasks" refers to actionable items created to achieve a Goal, whether created manually or through AI Services.

Account Registration

To use certain features of our Application, you may need to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information

• Maintain and update your information as needed

• Keep your password secure and confidential

• Be responsible for all activities that occur under your account

We reserve the right to disable any user account if we believe you have violated these Terms.

Subscriptions and Payments

Subscription Options

We offer the following subscription options:

• Monthly AI Pro Subscription: Billed monthly

• Yearly AI Pro Subscription: Billed annually at a discounted rate

• Lifetime Pro Access: One-time payment for permanent access to non AI features

Exact pricing is displayed within the Application and may vary by region or currency.

Lifetime Pro Access

The Lifetime Pro Access includes:

• Access to Calender Event Creator

• Access to Pomodoro Settings

• Access to Advanced Progress Tracking

Pro Subscription Features

The Pro Subscription includes:

• Access to AI-powered goal breakdown functionality

• Access to AI-powered image-to-task conversion (limited to 20 image uploads per month)

Free Trial

We may offer a 14-day free trial of premium features. By activating the free trial:

• You'll have access to premium features for 14 days at no charge

• No payment will be collected during the trial period

• You will need to purchase a lifetime premium access or AI subscription to continue using premium features or AI-powered features after the trial ends

Payment Processing

All payments are processed through the Apple App Store or Google Play Store. Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel your subscription through your App Store or Google Play account settings.

Refund Policy

Refund requests are handled by Apple or Google according to their policies. We do not directly process refunds for in-app purchases. Please contact Apple App Store or Google Play Store support for refund requests.

AI Features and Services

AI Goal Breakdown Feature

The Application offers AI-powered goal breakdown functionality that converts user-entered goal titles into actionable subtasks. This feature:

• Is available exclusively to users with an active Pro Subscription

• Utilizes third-party artificial intelligence services provided by DeepSeek and OpenAI

• Processes user-entered goal titles through these third-party services

• May be subject to temporary unavailability if third-party services experience downtime

AI Image-to-Task Conversion Feature

The Application offers an image-to-task conversion functionality that transforms photos into digital todo or goal lists. This feature:

• Is available exclusively to users with an active Pro Subscription

• Allows access to device camera and/or photo gallery to capture or select images

• Utilizes OpenAI's image processing capabilities

• Is limited to a maximum of 20 image uploads per calendar month

• Processes uploaded images through OpenAI's services

• May be subject to temporary unavailability if third-party services experience downtime

AI-Generated Content

When using our AI goal breakdown feature:

• You retain ownership of your original goal titles

• We grant you a license to use, modify, and implement the AI-generated subtasks within and outside the Application

• You acknowledge that AI-generated subtasks are provided "as is" without warranties of accuracy, completeness, or suitability for specific purposes

• You can edit and customize AI-generated subtasks according to your preferences

When using our AI image-to-task conversion feature:

• You retain ownership of your original images

• We grant you a license to use, modify, and implement the AI-generated tasks derived from your images

• You acknowledge that AI-generated tasks from images are provided "as is" without warranties of accuracy, completeness, or suitability for specific purposes

• You can edit and customize AI-generated tasks according to your preferences

• You are responsible for ensuring you have the right to use and upload any images submitted

Limitations of AI Services

You understand and agree that:

• AI-generated subtasks and tasks may vary in quality, relevance, or usefulness

• We do not guarantee the availability of AI features at all times

• We are not liable for any outcomes resulting from implementation of AI-generated subtasks or tasks

• We reserve the right to modify, improve, or discontinue AI features at any time

• Third-party AI services may have their own terms of service that apply to your content when processed

• Image-to-task conversion is limited to 20 uploads per calendar month per subscription

• Unused image upload allowances do not roll over to subsequent months

• We reserve the right to refuse processing of images that violate our content policies

Intellectual Property

Our Intellectual Property

The Application and its original content, features, and functionality are owned by Dolevate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Modify, distribute, or create derivative works based on our Application

• Use the Application for any commercial purpose without our consent

• Reverse engineer or attempt to extract the source code of our Application

• Remove any copyright or other proprietary notices

User Content and AI-Generated Content

You own the content you create and enter into the Application, including your goals and any modifications you make to AI-generated subtasks.

For AI-generated content:

• We claim no ownership over AI-generated subtasks

• You receive a perpetual, worldwide, non-exclusive license to use, modify, and implement AI-generated subtasks

• Neither we nor our AI service providers claim copyright in the AI-generated subtasks

User Content

You may have the opportunity to create, post, or share content through our Application. By posting content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Application.

You represent and warrant that:

• You own or have the right to use and authorize us to use your content

• Your content does not violate the privacy rights, publicity rights, copyright, contractual rights, or any other rights of any person or entity

Prohibited Uses

You agree not to use the Application in any way that:

• Violates any applicable laws or regulations

• Infringes upon the rights of others

• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable

• Involves sending spam or unsolicited messages

• Impersonates any person or entity

• Interferes with or disrupts the Application or servers

• Attempts to gain unauthorized access to any part of the Application

• Uses the AI features to generate harmful, illegal, or unethical content

• Uploads images that contain illegal, pornographic, violent, or otherwise prohibited content

• Uploads images to which you do not have rights or proper authorization

• Attempts to circumvent the monthly image upload limitation

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Application.

Specifically, we shall not be liable for:

• Inaccuracies, errors, or omissions in AI-generated content

• Unavailability of AI features due to third-party service interruptions

• Any decisions, actions, or outcomes resulting from your use of AI-generated subtasks

• Losses or damages arising from your reliance on AI-generated content

Termination

We may terminate or suspend your account and access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Application will immediately cease

• Your active goals and AI-generated content will remain in our systems until your account is deleted

• If you wish to terminate your account, you may discontinue using the Application or contact us to request account deletion

• Upon account deletion, your goals and AI-generated content will be removed from our active systems

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes through the Application or by other means. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.

International Use

The Application is intended for use worldwide. However, you agree to comply with all local laws regarding online conduct and acceptable content. You specifically agree to comply with all applicable laws regarding the transmission of technical data exported from your country of residence.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. If you are accessing the Application from outside the United States, you are responsible for compliance with local laws.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
